Limitations of Liability
These paragraphs, together with the Release of
Liability form which each participant must sign, define Adventurous Wench's
responsibility with respect to all trips. Payment of your deposit
represents your acceptance of these following terms and conditions.
There are certain risks and dangers inherent in any
form of adventure travel. Adventurous Wench assumes no responsibility or
liability for any claims or damages, for any reason, arising from these
risks. The Release of Liability and Personal Information forms must be
completed and signed by each guest, and received by our office at least 30
days prior to the departure date. If these signed forms are not received at
least seven days prior to the departure date, Adventurous Wench has the
right to consider that reservation cancelled.
Without limitation, Adventurous Wench is not
responsible for any bodily injury, property damage, death, delay or
inconvenience which may be occasioned by any cause whatsoever, including
(but not limited to) acts of God, forces of nature, civil disturbance,
terrorism, criminal activities, physical exertion for which a guest is not
prepared, failure of any means of conveyance, consumption of alcoholic
beverages, dangers associated with animals or recreational activities,
breakdown of equipment, high altitude, or limited access to medical
attention.
Adventurous Wench is not liable for expenses not
specified in the trip itinerary, including: a) meals, transportation or
hotel costs not specified as included in the trip cost, but which may be
required to get to or from a trip start or end, b) expenses caused by a trip
delay for any reason whatsoever, c) expenses pertaining to luggage lost by
airlines or left behind on a trip.
Adventurous Wench hereby gives notice that it acts only
in the capacity of agent for hotels, restaurants, sightseeing tours, and
other suppliers of services and transportation, and assumes no
responsibility or liability whatsoever in connection with the operations,
safety, condition, and services provided by any such third parties. All
such persons and entities are independent contractors. As a result,
Adventurous Wench is not liable for any negligent or willful act or failure
to act of any such person or entity, or any other third party.
Adventurous Wench reserves the right, in its good-faith
discretion, to make itinerary modifications as necessary to improve the trip
quality or to accommodate the comfort and well-being of guests. This
includes, but is not limited to, the right to alter or omit any part of the
itinerary, to substitute hotels or guides, to change the sequence of
activities, or to change any means of conveyance.
Adventurous Wench reserves the right to take
photographs or make video records of any of its trips. Guests grant
Adventurous Wench express permission to use such photographs or videos for
promotional and/or commercial use, as well as approve such use by third
parties with whom Adventurous Wench may engage in joint marketing, without
financial remuneration.
Adventurous Wench reserves the unilateral right to
accept or reject any person as a trip member at any time. A trip member may
be restrained from further participation if, in Adventurous Wench's sole
judgment, the individual's actions impede the operation of the tour, pose a
threat to the welfare or enjoyment of any group member, or are unsuitable
for group travel. A refund based on the cost of any unused land services
already paid for is the limit of Adventurous Wench's responsibility in such
a case.
